Plaintiff claims defendant published one of his picture of President Obama without his authorization. Defendant claims he paid $300 for the picture, admits he published the picture before the money cleared. Plaintiff says he quoted $300 to take a picture of the art, they were going to use it for promotional posters. No written contract, plaintiff showed emails back and forth before the payment; there was no agreement to put it on a magazine which is what defendant did. The artist was present in court with the original art. Defendant delayed the payment for $300 with different excuses for 4 months. Originally plaintiff asked for $300, now he is asking for $5000. Judgment for the plaintiff: $300, interest, court fees.
