Plaintiff claims that defendant stole his Nintendo DS Console. Later on said not stole, he acted negligent. Parties rode the car together to a back to school barbecue, the Nintendo DS was in the car, defendant was playing with it, they arrived at the place, and, defendant took it with him; defendant claims that when he was done playing with it he put the game on plaintiffs car, through a crack in the window as he was told; they claim they are not responsible on what happened with it. Plaintiff claims they all went to the car and did not find the game there.
